Motion to Set Aside Default
Unlawful detainer case. Defendant moves to set aside the default and judgment on the basis that plaintiff did not serve defendant with summons and complaint and filed a false return of service with the court. Defendant asks that possession of property be returned to defendant absent a valid judgment.
