Sample Motion to Expunge Lis Pendens and Fraudulent Mechanics Lien
Installer filed a mechanics lien on home for unpaid bills. Homeowner never received services or materials which were the basis of the lien. A lis pendens was based on the mechanics lien. Homeowner's attorney informed installer's attorney that they never received goods or services, but installer did not remove mechanics lien. This motion has extensive statutory and case law authority for the expungement of the lien.
