Motion to Expunge Lis Pendens
Defendant moves to expunge plaintiffs' lis pendens, which is preventing the sale of the property, on the basis that the lis pendens is defective on its face since defendant was not notified before recording, there is not a liklihood of success since plaintiffs' complaint is barred by the statute of frauds, and plaintiffs have failed to state a valid real property claim. Defendant also asks for an undertaking.
