Opposition to Motion for Terminating, Evidentiary and Issue Sanctions
Defendant was ordered to amend certain discovery responses following a motion to compel and plaintiff filed a motion for sanctions arguing that defendant wilfully failed to comply with the order and should be sanctioned. Defendant argues here that it is in compliance with the order, there is no wilful disregard, no prejudice to plaintiff, and terminating, issue, and evidentiary sanctions are unwarranted.
